REOPENING OF COURTS: Agitation by Jammu lawyers continues for 37th day

Jammu, Nov 21: The agitation launched by the lawyers practicing in Jammu wing of J&K High Court and the Subordinate Courts since 15th of October, continued on 37th day today. The lawyers Action Committee, carrying ahead the agitation held DHARNA in the Court Complex Janipura Jammu. The lawyers are protesting against closure of their continued complete entry into High Court and partial entry in Subordinate Courts besides no entry of public since March end this year. When other spheres like business, politics and elections, marriage gatherings, conducting proceedings of parliament and assemblies, cinema halls, liquor bars, bus and air transport etc resumed functioning, the public and lawyers were expecting physical hearings in courts, but doors of courts remained closed for lawyers and public for no genuine reason. The Lawyers in Jammu had to launch agitation with the major demand of opening doors of court and resumption of physical hearings in High Court and Subordinate Courts besides other demands for accepting hard copies, opening of closed Bar Rooms of lawyers and other facilities of lawyers in court complex, providing stamp papers and tickets in court area through stamp vendors, holding of elections for J&K Bar Council, opening of wound up consumer courts in J&K, shifting back Registration of documents from Revenue Officers to Judicial Officers, withdrawing contempt cases against some lawyers.
Though there is slight improvement of entry for lawyers in subordinate courts, yet trials remain suspended and undertrials suffering in jails. There is no improvement in High Court and facilities of lawyers still closed. The Lawyers Action Committee, carrying struggle on the issues, has expressed anguish over adamant attitude of the authorities concerned. Judiciary is the savior of Constitutional and legal rights of citizens and has to keep its doors open for providing justice. The Lawyers, who are officers of Courts, are sine qua non in the judicial system. Restraining lawyers from performing their duties amounts to denial of justice to the citizens. Other issues like shifting of Registry to Revenue from Judicial authorities causing much suffering to people and the lawyers. After repealing of J&K Consumer Protection Act since August 2019, there is no consumer court in J&K resulting into denial of justice to the consumers and the right of practice of the lawyers. Stamp Papers and tickets are not made available in court premises. Election to J&K Bar Council has never been held and power remains with High Court since its inception, this is denial of democratic rights to the lawyers. Even directions of Supreme Court remain unimplemented. The Lawyers have compulsion to agitate when concerned authorities are maintaining silence. Jalmeria, RK Gupta Senior Advocate, SK Anand, SS Chib, CS Gupta, Babu Ram Sharma (former vice president), JP Gandhi, BS Jamwal, Shah Mohd Choudhary, Subodh S Jamwal, Ashok Chib, Manohar Gupta, Jyoti Sarup, Zoya Bhardwaj, Meharban Singh, Manohar Lal, Abrar Ahmed, Sachin Dogra, Mohd Rashid, Kunal Singh Chib, Baldev Singh, Dinesh Singh, Manohar Anthal, Harsh Sharma, Arvind Singh Jalmeria, Jyoti Sharma, Seema Choudhary, Kamla Spolia, Rahil Manhas, Amzi Arthur John, Karan Pandoh, Sham Lal, besides others.
