Jammu, Apr 9: Chief Judicial Magist-rate Jammu Amarjeet Singh Langeh today took serious view against Crme Branch for not obeying the court directions and directed SSP Crime Branch to file compliance report before next date of hearing.
CJM Jammu Amarjeet Singh Langeh observed that Complainant invoked section 156(3) of Cr.P.C for registration of FIR by Crime Branch Police Station Jammu for offences involving forgery, forgery of valuable security for the purpose of cheating, using as genuine of forged document and knowingly making false statement before public servant following which vide order dated 15.3.2021, SSP Crime Branch, Jammu seems to have been directed to register FIR and depute responsible officer to investigate the matter under relevant provisions of law and matter was posted for compliance report on 29.3.2021. On 29.3.2021, a report was submitted by Deputy Superintendent of Police Crime Branch, Jammu through prosecution that preliminary enquiry into the matter has been initiated in the matter which will be concluded on its merits.
CJM observed that once SSP Crime Branch, Jammu was under categoric direction to register the FIR in terms of section 156(3) of Cr.P.C in the matter and proceed with the investigation by deputing responsible officer, the course adopted by the Crime Branch to initiate preliminary enquiry, seemingly - unmindful of direction under 156(3) of Cr.P.C as aforesaid is indeed - an aspect whose rationale needs to be clarified by the Crime Branch, Jammu and directed SSP Crime Branch to do needful before next date of hearing.
