12/05/2021

JAMMU, May 11: Addi-tional Sessions Judge Kathua Kamlesh Pandit rejected the bail application of one Harjinder Singh R/o Hoisharpur from whom Police post Ramkot at Dhar Road while driving vehicle bearing registration
number PB35Q/1459 and on checking 53 kgs and
740 gms of Poppy Straw (commercial quantity)
was recovered.
While rejecting the bail application, Additi-onal Sessions Judge Kathua Kamlesh Pandit after hearing both the sides observed that the illegal trafficking and trade in Narcotic Drugs and Psychotropic substances has posed potential threat to the whole society as it is eating the very vitals of the society and the menace of traffickers is spreading its tentacles to every nook and corner of the U.T of Jammu & Kashmir cannot be ignored when the recovery of contraband is on the higher side. The release of the accused
person at this stage will definitely have its adverse effect on the trial.
The drug traffickers like accused persons are spreading the addiction of Narcotics & Psychotropic substances among the human race especially the youth section of society making them slaves of the same, who when become addicts not only spoil their lives but also ruin the lives of their family members. Therefore, the release of such accused person at this stage will not meet the ends of justice. Consequently in the facts and circumstances of the instant case, the apprehension of the prosecution appears to be reasonable that once the accused person is admitted to bail, he will not debar himself from tampering with evidence, repeating the offence and hindering the further trial in the case also.
