Court rejects bail plea of Rohingya

Jammu, Jan 8: CJM Jammu Amarjeet Singh Langeh rejected the bail application of one Abdul Ghafor who was arrested by the police in FIR No. 405/2021 for offences under sections 467/468/ 471 IPC, Section 3 PEI Act and Section 14 of Forei-gners Act registered with Police Station Bahu Fort.
CJM Jammu Amarj-eet Singh Langeh after hearing APP Kuldeep Kumar for the Police observed that petitioner is a co-accused in FIR No. 405/2021 for offences under sections 467/468/ 471 IPC, Section 3 PEI Act & Section 14 of Foreigners Act registered with Police Station Bahu Fort; that during investigation, it came to fore that petitioner wilfully and knowingly facilitated another accused namely Zameer Ahmed, a foreigner in crossing over to Indian Territory illegally and without any valid documents; that petitioner has conspired with aforesaid accused and prepared fake and forged documents enabling him to evade and escape from the eyes of security agencies with ultimate goal to carry out illegal activities in India in general and in UT of J&K in particular; that petitioner has helped accused Zameer Ahmed in obtaining admission in Deoband- UP on fake and forged documents; that investigation is at initial stage, that ofence under secion 467 of IPC carries punishment with life imprisonment; that peiioner is the kingpin of this racket of collecting money, forging documents & managing entry of foreigners illegally into UT of J&K.
While rejecting the bail application, CJM Jammu Amarjeet Singh Langeh observed that The approach of Investigating agency springs out a surprising element not difficult to be discerned. The investigation is being conducted by a Probationer Sub Inspector. Given the gravity of the allegations and complexity of the web of circumstances needing in depth probe that police itself alludes to case in hand, it then is not fathomable as to what weighed with the higher-ups in the investigating agency in not displaying commensurate sensibility in the matter of investigation of a crime that allegedly has huge ramifications of grave proportions for the security of the country as a whole, a fact that is also asserted in the report submited by police itself. Copy of this order shall go to SSP Jammu for information and necessary action as may be deemed appropriate.
