DB directs SMC to file affidavit within four weeks in PIL seeking establishment of Industrial area

JAMMU, Nov 29: In a Public Interest Litigation filed by Inhabitants of Hill view Colony Old Air llege that on account of the establishment of an industrial area they are facing health hazards due to discharge of effluents from the industrial units as there is no proper arrangement for treatment of the waste and effluents.
When the PIL Came-up for hearing, Division Bench of Jammu & Kashmir and Ladakh High Court Comprising Chief Justice Ali Mohammad Magrey and Justice Sanjay Dhar, observed that In terms of order passed on 31.05.2022, the counsel appearing for the Srinagar Municipal Corporation was directed to file an affidavit, indicating the steps to remove the deficiencies as pointed out in the order.
DB directed the affidavit from the Commissioner, SMC, Srinagar within four weeks.
It is worthwhile to mention here that on May 31, 2022, The Division Bench observed that On the letter dated 02.09.2020 of the inhabitants of the area addressed to the Chief Justice of High Court of Jammu and Kashmir, this PIL was registered in context with the cleaning of the industrial area. The Regional Director J&K Pollution Control Board, District Officer PCB, Budgam, had pointed three deficiencies and had recommended that the CETP (Common Effluent Treatment Plant) needs to be made operational and the treated water needs to be channelized for irrigation purposes; the drains in the industrial estate are required to be cleaned and cleared regularly to ward off blockage/choking; and solid waste generated within the industrial estate should be channelized to some municipal body for scientific disposal. All the aforesaid jobs have to be taken care of by the Srinagar Municipal Corporation.
In view of the above, DB directed Sh. Moomin Khan, counsel appearing for the Srinagar Municipal Corporation to file an affidavit indicating as to the steps taken by it to remove the above deficiencies. The report be filed within a month.
