HC restrains ACB from presenting challan against then Tehsildar Bahu

Jammu, Jan 9: In a petition filed by Rohit Sharma then Tehsildar Bahu who was allegedly caught red-handed by Anticorru-ption Bureau, Justice Javed Iqbal Wani after hearing Sr. Adv Sunil Sethi with Adv Parimoksh Seth restrained the Anticorruption Bureau to file Charge-sheet.
In the petition the petitioner is aggrieved of a highly motivated and dramatized trap laid by the team of Anti-Corruption Bureau, Rajouri in reference whereof the petitioner has been wrongly and falsely implicated in criminal case FIR No. 02/2022 registered with Police Station, Anti-Corruption Bureau, Rajouri (camp Jammu) under section 7 of the Prevention of Corruption Act, 1988. That while serving as Tehsildar, Bahu, the petitioner has been wrongly and falsely implicated in FIR No. 02/2022 registered with Police Station, Anti-Corrup-tion Bureau, Rajouri (camp Jammu) under section 7 of the Preven-tion of Corruption Act, 1988 with the allegations that the petitioner has demanded illegal gratification/ bribe, which has been recovered from his possession by the Anti-Corruption Bureau Personnel i.e. respondents 6 to 12 after laying a trap. The petitioner was arrested in the aforesaid FIR and later on granted bail by the High Court.
It is pertinent to mention that the whole drama of trap and subsequent arrest of the petitioner was highly manipulated and in fact nothing of the sort, as has been projected in the trap proceedings or in the FIR had ever taken place. The petitioner has been wrongly and falsely implicated.
The petitioner is completely innocent. That luckily for the petitioner, the alleged trap proceedings have taken place in the premises in which the office of Tehsildar, Bahu, Jammu is located and which building was having CCTV coverage and is in possession of the owner of the building. The CCTV camera footage which is in the public domain clearly indicates that the whole trap was a farce and forged and the trap was laid down to falsely implicate the
petitioner. A pen drive in original, containing 4 CCTV footage clips of the day, depicting the alleged trap proceedings, is enclosed.
Justice Javed Iqbal Wani after hearing Sr. Adv Sunil Sethi with Adv Parimoksh Seth for the petitioner whereas Sr. AAG Monika Kohli for the UT, Issue notice to the respondents, returnable within three weeks. Requisite steps for service within one week.
Meanwhile, subject to objections and till next date of hearing before the Bench, the investigation in impugned FIR No. 02/2022 dated 14.11.2022 shall proceed, however, upon completion of the investigation, in the event charge-sheet is contemplated to be filed,
the same shall await the orders of this Court. JNF
