Court denies bail in murder case

Jammu: Principal Sessions Judge Jammu Mr. RS Jain today rejected the bail application of Bhagwan Singh and Daljeet Singh who are facing trial in murder case.
According to police case that on 28.2.2012, accused in pursuance of a criminal conspiracy compelled the deceased Shanker Singh to board their truck No. JK-2AN/3054 which was laodd with iron rods and was going towards Poonch. On the way, the accused and deceased consumed liquor and then some altercation took place between them. When the truck reached near Akhnoor bridge, the petitioners started beating the deceased who told the accused to stop the truck but they did not stop the truck whereupon deceased jumped out of the truck. The accused got down from the truck and beat the accused with tyre rod, as a result of which the deceased fell down and his dead body was thrown into the river Chenab.
Principal Sessions Judge Jammu Mr. RS Jain after hearing both the sides observed that PP has averred that accused are involved I n heinous offence of murder which carries the death sentence or life imprisonment and that the prosecution is yet to produce material witnesses and the evidence led by the prosecution connects the accused to the commission of offence with which they have been charged. In case the accused are enlarged on bail, they will jump bail and tamper with the prosecution and held that the allegations leveled against the accused are of very serious nature and against the society. Hence, looking to the allegations leveled against the accused and the larger interest of the State and the public as well as the settled law, Court is of the opinion that no good ground is made out for granting bail to the petitioners Bhagwan Singh and Daljeet Singh and rejected the same.
