Court restrains airing of offending video

Jammu, Oct 7: In a significant order, CJM Kathua, Swati Gupta has restrained the Facebook (now Meta) through its CEO, Youtube through its CEO, Amit Ajrawat Rep-orter of Jammu Samvad (Media/News Agency) & Lalit Khajuria, Editor, Owner and Publisher of Jammu Samvad, from airing the offending video at their web portal as well as social media vis a vis plaintiff as the offending video contains a defamatory story aired on their Web Portal 'Jammu Sam-vad' on September, 2023 entitled 'JKAS Officer Ban Gayi Farzi GST Officer, FIR registered, Hosh Udaa Degi Khabar' wherein the defamatory allegations were levelled against the plaintiff i.e. Tasbina She-ikh, JKAS Officer presently posted as Deputy Registrar Cooperatives Kathua, in a civil suit for mandatory injunction & permanent prohibitory injunction filed by JKAS Officer. In the offending video, time and again an emphasis was laid and public at large is made to understand that the JKAS officer impersonated as a GST Officer before Talib Hussain who runs a Hardware shop at Bani, without ascertaining the version of the plaintiff.
Adv Kirti Bushan Mahajan appearing for the JKAS Officer submitted that the News Portal 'Jam-mu Samvad' aired a defa-matory video against the JKAS Officer in the public domain without ascertaining the version of JKAS Officer and by suppressing and concealing the vital facts from the public at large, the video being managed at the behest of Mohd Araf(JE), Talib Hussain and Akash Kumar all residents of Bani, who were nursing a grudge against the plaintiff and her family members. The offending video was aired with an oblique motive to malign the image of the plaintiff so that her family members may not press an FIR No. 0037/2023 dated June 28, 2023 lodged against aforementioned three persons, pursuant to which, Mohd Araf (JE) was attached to the Admi-nistrative Department at Civil Secretariat Jammu.
After hearing Adv. Kirti Bushan Mahajan, the Court of Civil Judge (Sr. Division)/CJM, Kathua has restrained the Face-book through its CEO, Youtube through its CEO, Amit Ajrawat Repo-rter of Jammu Samvad (Media/ News Agency) & Lalit Khajuria, Editor, Owner and Publisher of Jammu Samvad, from airing the offending video at their web portal as well as social media vis a vis plaintiff. Court put up the matter on 27/10/2023 for appearance and filing of objection by non-applicants. JNF
