HC directs PDD to pay Rs 31.90 lakh compensation

JAMMU, Apr 30: Justice Rajnesh Oswal of Jammu & Kashmir and Ladakh High Court irected Power Development Department (PDD) to pay compensation to the tune of Rs 31,90000 to 14 years old boy who suffered from disability because of sheer negligence of the respondents in maintenance of the electric wires.
The petitioner Mauju, a minor boy aged 14 years, has approached this Court through his father for directing the respondents to pay the compensation of Rs.80.00 lacs to him on account of disablement suffered by him in the form of below elbow amputation of left upper limb due to an incident of electrocution occurred because of negligence and carelessness on the part of officials of the respondents in maintaining the high tension wires. It is stated that on 31.01.2017, the petitioner had gone for grazing his livestock when he came into contact with the broken live electricity transmission wire of 11 KV in the field, as a result of which the petitioner suffered serious and grave injuries to his left upper limb.
Justice Rajnesh Oswal after hearing both the sides observed that writ petition is disposed of by directing the respondents to pay an amount of Rs. 31,90,540/- to the petitioner along with interest @ 6 percent per annum except on the components of compensation on account of future earnings, attendant's expenses and marriage prospects, from the date of filing of the writ petition till its final disbursal.
Out of the said amount, an amount of Rs. 15,00,000/-shall be kept in fixed deposit in the name of the petitioner for a period of three years and thereafter the petitioner shall be at liberty to withdraw the same.
In the event, the petitioner requires more money for any justifiable purpose he shall be at liberty to approach this Court.
