JKP Constable gets Promoted as ASI, complying CAT’s direction

JAMMU, Jul 13: The Central Administrative Tribunal (C.A.T), Division Bench comprising Justice Rajinder Singh Dogra (J) and Judge Ram Mohan Johri (A), passed an order on 12th September 2024 and disposed of Transferred Application No. 5977 of 2021 titled Shabir Ahmed versus State of J&K and Others. The Bench directed the respondents, the J&K State Authorities (now Union Territory), that the order passed by the then concerned SSP Police Jammu dated 19-01-2010-disagreed upon by Police Headquarters and the Director General of Police, J&K-was not accepted via a speaking order dated 06-02-2010.
The Tribunal directed that the order of the Director General of Police be considered and that action be taken in accordance with law. The petition was filed through Advocate Sh. A.K. Sawhney.
IGP Jammu, Mr. Bhim Sen Tuti, thoroughly examined the file and the court's order, which was passed in favor of Mr. Shabir. Advocate A.K. Sawhney argued the case in depth before the Hon'ble Bench of the C.A.T, Jammu, and contended that the police authorities were ignoring their own order passed by the Director General of Police, J&K, and that promotions were being given orally without any written order.
The Hon'ble Bench of the Tribunal, after considering the file and arguments, passed the aforementioned order. IGP Mr. Bhim Sen Tuti showed active interest in ensuring justice was served, which had been pending for a long time.
As a result, the petitioner was promoted twice-from Constable to Assistant Sub-Inspector (ASI) of Police-amounting to justice finally being delivered.
Advocate A.K. Sawhney was assisted by Ms. Tehseena Bukhari, Advocate Mohd. Kashif Malik, and Advocate Mohd. Shabab Malik.
