HC cautions against lapses in Defence Personnel Trial Procedures

JAMMU, Aug 18: The High Court of Jammu & Kashmir and Ladakh has issued a strong caution to all judicial officers across the Union Territories, directing them to strictly adhere to newly notified guidelines governing the trial and disposal of cases involving defence and Central Armed Police Forces (CAPF) personnel.
The directive was conveyed through a circular issued by Registrar Vigilance Rajeev Gupta under the orders of the Chief Justice. The circular pointed out that certain courts had been found in breach of the prescribed norms, despite the recent issuance of specific notifications designed to streamline judicial handling of cases pertaining to uniformed personnel.
According to the High Court, the guidelines were laid down vide Notification No. 2376/RG dated July 21, 2025, titled "Guidelines for Trial and Disposal of Cases of Defence Personnel by Officers of the District Judiciary". Additionally, amendments to the J&K General Rules (Civil) of Svt. 1978, through Notification No. 2449 of 2025/RG/GS dated July 25, 2025, were also introduced for the guidance of district and subordinate courts in the Union Territories of J&K and Ladakh.
"These guidelines and rules have been issued with a view to ensure uniformity, efficiency and fairness in judicial processes concerning cases of members of the Armed Forces and CAPFs," the circular stated. It further underlined that any deviation from these directions shall be viewed seriously.
