HC steps in after cardiac services collapse at GSSH over unpaid PMJAY dues

JAMMU, Dec 9: The High Court of Jammu & Kashmir and Ladakh has taken suo motu cognizance of the alarming situation at the Government Super Speciality Hospital (GSSH), Jammu, where cardiac services reportedly came to a standstill after authorised suppliers suspended the supply of emergency cardiac devices due to unpaid dues nearing Rs 30 crore under Ayushman Bharat PMJAY.
The development came to light during hearing of a bunch of four long-pending public interest petitions including PIL No. 2/2018, PIL No. 37/2013 and PIL No. 16/2018, seeking directions for adequate medical facilities and infrastructure in capital cities and urban areas, besides regulation and monitoring of private nursing homes and medical institutes as per Government of India guidelines.
A Bench headed by the Chief Justice Arun Palli and Justice Rajnesh Oswal noted that as per the newspaper report placed before the Court, supplies of stents, pacemakers, balloons and Cath Lab consumables were stopped due to the pending payments. The Court observed that the hospital's Cath Lab operations were completely paralysed, and that while GSSH normally performs around 25 cardiac procedures daily, not a single heart-related intervention could be carried out that day, placing vulnerable patients at serious risk.
Earlier, the Court had requested Mr. S.S. Ahmed, Advocate to assist as Amicus Curiae. The amicus submitted that despite around 15 status/compliance reports filed over time, there had been no tangible results and sought short accommodation to collate the reports and place suggestions before the Bench. Accepting the request, the Court deferred the proceedings in the PILs to December 29, 2025.
In view of the gravity of the hospital crisis, the Bench directed the Registrar (Judicial) to register and number a separate petition titled "Court on its own motion vs. Nemo" in public interest and place it before the Bench during the course of the day.
