Division Bench gives final opportunity to comply with orders on govt quarters

JAMMU, Dec 24: A Division Bench of the High Court of Jammu & Kashmir and Ladakh (Jammu Wing) comprising the Chief Justice Arun Palli and Justice Rajnesh Oswal has reluctantly granted time till 30th Dec., 2025 to Sr. AAG Monika Kohli appearing for Estates Department to comply order dated November 17, 2025 and the previous orders whereby the Division Bench had directed to conclude the process with regard to the Govt. Accommodation in respect of two high profile politicians namely Ghulam Nabi Azad Ex-Chief Minister of erstwhile J&K State and Ex-BJP Chief of J&K Ravinder Raina who are still enjoying the Govt. Accomm-odation.
The Division Bench headed by the Chief Justice Arun Palli and Justice Rajnesh Oswal observed that upon being pointedly asked, Sr. AAG Monika Kohli concedes that the process is still inconclusive, for, the concerned Officer, owing to a pressing administrative commitment, was not in town and the Sr. AAG Monika Kohli prays for a short accommodation to furnish the required affidavit in this regard.
At this stage, Advocate S.S.Ahmed with Advocate Supriya Chouhan appearing for the petitioner submitted that the recommendations of the Designated Committee are not being taken to the logical conclusion as the illegal occupants are big wigs and the Estates Department is delaying the matter deliberately as almost ten months have elapsed since the receipt of the recommendations of the Designated Committee. Advocate Ahmed further submitted that on the last date of hearing i.e. November 17, 2025 the Division Bench had categorically directed that no further adjournment in this regard shall be granted.
After considering the submissions of both sides, the Division Bench comprising the Chief Justice Arun Palli and Justice Rajnesh Oswal reluctantly allowed time till 30th Dec., 2025 to Sr. AAG Monika Kohli to file an affidavit with regard to the conclusion of the process on the recommendations of Designated Committee with regard to the Govt. Accommodation in respect of two high profile politicians namely Ghulam Nabi Azad, Ex-Chief Minister of erstwhile J&K State and Ex-BJP Chief of J&K Ravinder Raina.
In yet another Writ Petition (OWP No. 1120/2017) filed by Ex-MLC Ravinder Sharma, Sr. Advocate S.M. Choudhary with Advocate Bilal A. Choudhary appearing for the Ex-Legislator fairly submitted before the Division Bench that the petitioner is ready/ willing to vacate and deliver the actual physical possession of the premises to the Estates Authorities. But, he be granted two months' time to make an alternate arrangement.
Sr. Advocate S.M. Choudhary prayed for a short accommodation to file a specific affidavit in this regard.
Looking into the Public Interest involved in the matter, the Division Bench directed the Registry to re-notify the instant PIL for 30.12.2025 'higher up' in the cause list.
