DB closes PIL on new Jammu High Court Complex, says ‘concrete results’ expected soon

JAMMU, Feb 9: The High Court of Jammu & Kashmir and Ladakh has disposed of a Public Interest Litigation seeking progress on the construction of a new building for the Jammu Wing of the High Court, after being informed that substantial progress has been made in formulation of the proposal and that the matter is being actively pursued through continuous deliberations with the Union Territories.
The order was passed by a Division Bench comprising Justice Rajnesh Oswal and Justice Mohd. Yousuf Wani in WP(C) PIL No. 13/2025, titled Arjun Gandotra vs UT of J&K & Ors, heard through virtual mode.
The petitioner Arjun Gandotra was represented by Senior Advocate Sunil Sethi, while Gandotra also appeared in person before the court. On behalf of the respondents, Senior AAG Monika Kohli represented respondents 1 to 4, and Advocate Monika Thakur appeared for respondent No. 8.
During the hearing, Advocate Monika Thakur, under instructions, submitted that substantial progress has already been achieved in shaping the proposal for the new High Court building at Jammu and that the High Court is in continuous deliberations with both the UT of Jammu & Kashmir and the UT of Ladakh regarding the project. She further submitted that, since the matter is being actively pursued at the institutional level, no fruitful purpose would be served by keeping the PIL pending at this stage.
Taking note of the statement, the Bench observed that it found no reason to continue with the PIL and accordingly disposed of the petition. The Court recorded that it was sanguine that the deliberations and efforts being made by the High Court and both UTs would yield fruitful results within a few months.
At the same time, the Bench protected the petitioner's right to approach the Court again if the assurances do not translate into action. The PIL was disposed of with liberty to the petitioner to seek revival of the matter if the efforts do not fructify into "concrete results.
