HC orders flouted: CAT issues warning to Bandipora DC, may order arrest

Srinagar, Apr 1: The Central Administrative Tribunal Srinagar on Tuesday came down heavily on the Deputy Commissioner, Bandipora, for "gross disobedience" of court directions in a compassionate appointment case and warned of coercive action, including arrest, if compliance is not ensured.
The Bench of M. S. Latif, while hearing a transferred application titled Hamida Begum vs General Admin-istrative Department, observed that repeated directions of the High Court as well as the Tribunal to produce records and file an affidavit had not been complied with.
Appearing for the applicant, advocate Adil Asmi submitted that the petitioner's claim for compassionate appointment had been unjustly rejected despite her having returned the compensation amount earlier granted in lieu of appointment. Counsel for the respondents, Raisud din Ganaie, informed the Tribunal that the relevant record had been arranged but was not readily available in court and sought time to produce the same along with the affidavit as directed earlier. The Tribunal noted that despite clear directions, neither the Deputy Commissioner appeared in person nor was the record produced, compelling the court to consider invoking its powers under the Administrative Tribunals Act and Contempt Rules.
"This Court is at pains to see how court orders are being flouted with impunity by senior officials," the Bench remarked, adding that no one is above the law.
While refraining from immediate coercive action in view of the submission made by the government counsel, the Tribunal granted a final opportunity and directed that the record and affidavit be produced on the next date of hearing, failing which it may be constrained to secure the presence of the Deputy Commissioner through legal process. The matter has been listed for April 2.
