HC closes Ladakh gazetted recruitment PIL after UT says grievance redressed

JAMMU, Jul 7: The High Court of Jammu & Kashmir and Ladakh has closed a public interest litigation (PIL) relating to recruitment to gazetted cadre posts in the Union Territory of Ladakh after the administration informed the court that the grievance raised by the petitioners had been substantially addressed.
A Division Bench of Acting Chief Justice Sanjeev Kumar and Justice Mohd Yousuf Wani passed the order while disposing of an application in CM No. 1044/2026 in WP(C) PIL No. 5/2024, titled Gazetted Aspirants, Residents of Ladakh versus Union Territory of Ladakh.
The PIL had been instituted to examine the non-recruitment to gazetted cadre posts in Ladakh for nearly five years. The matter had earlier been disposed of on December 30, 2024, with liberty granted to the petitioners to seek revival of the proceedings if their grievances remained unresolved.
Senior Advocate Kachroo Manzoor Ali Khan, assisted by Advocate Aga Syed Hadi, appeared for the petitioners. T.M. Shamsi, Deputy Solicitor General of India, represented the Union Territory of Ladakh along with Advocate Rehana Qayoom.
During the hearing, the adminis-tration placed on record a status report dated April 23, 2026, stating that the necessary statutory and regulatory framework for recruitment had been put in place and that the process for filling gazetted posts through the Union Public Service Commission (UPSC) had already been initiated.
The court was informed that the recruitment process is presently at different stages before the UPSC and that appointments to gazetted posts in the Ladakh administration would be made in accordance with law after the Commission forwards its recommendations.
Taking note of the status report, the Division Bench observed that there was no justification for reviving the PIL.
"For the foregoing reasons, the proceedings in this PIL are closed," the Bench said while disposing of the application.
With the order, the High Court brought the proceedings to a close, recording that the issues raised in the PIL had been addressed by the respondent administration through the measures undertaken for recruitment to gazetted posts.
