NIA Court issues NBWs against two Pak-based LeT commanders in Kashmir terror case

JAMMU, Sep 17: A Special NIA Court in Jammu has issued non-bailable warrants (NBWs) against two Pakistan-based alleged Lashkar-e-Taiba (LeT) commanders in connection with a Kashmir terror case involving the recovery of a Chinese grenade and 15 live rounds.
Special Judge under the NIA Act, Jammu, PremSagar passed separate orders on September 8 against Khalid alias LalaHuzaifa alias Bakkarwali, stated to be a resident of South Punjab, Pakistan, and Saifullah alias SajidJatt alias Ali Bhai alias Habibullah Malik, a resident of Kasur district, Pakistan.
The National Investigation Agency (NIA), in its applications, submitted that both accused were presently in Pakistan and were evading arrest. The applications seeking issuance of warrants were moved by CIO NIA DySPAmit Sharma under Section 75 of the Bharatiya Nagarik Suraksha Sanhita (BNSS).
The case, registered as RC No. 02/2026/NIA/JMU, originated from an incident in which J&K Police, during naka checking at Gujar Tent, Pandach in Srinagar, intercepted a motorcycle allegedly being ridden by Mohammad NaqeebBhat of Batpora, Srinagar.
According to the prosecution case, one Chinese grenade and 15 live rounds/cartridges were recovered from his possession. FIR No. 24/2026 was subsequently registered at Police Station Zakoora under provisions of the Unlawful Activities (Prevention) Act, Arms Act and Explosive Substances Act.
During investigation, the NIA alleged that Khalid alias LalaHuzaifa was an active LeT commander operating from Pakistan and was involved in providing weapons, funds and directions to terrorists operating in Kashmir.
The agency further alleged that he had earlier operated as anLeT commander in Ganderbal and Bandipora before moving to Pakistan.
In relation to Saifullah alias SajidJatt, the NIA submitted that he is a designated terrorist under the Fourth Schedule of the UAPA and alleged that he was operating from Pakistan while providing weapons, funds and directions to terrorists in the Valley.
The agency also placed before the court material relating to communication IDs allegedly linked to Saifullah. According to the NIA, he had operated as anLeT commander in Kulgam between 2005 and 2007 before moving to Pakistan.
After examining the material placed on record, the court observed in both matters that the involvement of the accused had surfaced during investigation and that they were allegedly involved in terrorism. Since their attendance could not be secured through ordinary means, the court allowed the applications for issuance of NBWs.
The general non-bailable warrant issued against Khalid was forwarded to DIG, NIA Jammu for execution in accordance with law. In Saifullah's case, the NBW was forwarded to SSP Kulgam, with Yamrach, Kulgam recorded as his last known address in Jammu and Kashmir, for execution through the NIA as per procedure.
The allegations against the accused are subject to investigation and further judicial proceedings.
