HC upholds PSA detention, dismisses habeas corpus plea

JAMMU, Sep 28: The High Court of Jammu & Kashmir and Ladakh has dismissed a habeas corpus petition challenging the preventive detention of a Poonch resident under the Jammu & Kashmir Public Safety Act.
Justice Sanjay Dhar declined to interfere with the detention order dated May 5, 2025, passed by the District Magistrate, Poonch against Mohd Qayoom, a resident of Village Qasba in Haveli area, on grounds relating to the security of the State.
The petitioner had challenged the detention, contending that it was primarily based on FIRs registered in 1989 and 1992 and that the incidents were stale and lacked a live and proximate link with the detention order.
He also raised objections regarding the supply and explanation of the material relied upon by the detaining authority and the consideration of his representation.
The Government opposed the petition, maintaining that the detention was based on relevant material, including allegations concerning more recent activities, and that the statutory and procedural requirements had been duly complied with.
After examining the detention record and the submissions made by the parties, the High Court found no ground warranting interference with the detention order.
The court accordingly dismissed the habeas corpus petition along with the connected applications.
